I presenti Termini e Condizioni d'Uso (di seguito i “Termini”) disciplinano l'accesso e l'utilizzo della piattaforma Hoomie da parte degli utenti. Il servizio è gestito da Hoomie S.r.l., società costituita secondo il diritto italiano, con sede legale in Via Pier Carlo Boggio 41, 12100 Cuneo (CN), codice fiscale e partita IVA 04175400045 (di seguito “Hoomie” o la “Società”). Per ogni comunicazione relativa al servizio l'utente può scrivere all'indirizzo assistenza@hoomie.it; per le comunicazioni di carattere societario e istituzionale è disponibile l'indirizzo info@hoomie.it.
La piattaforma comprende il sito istituzionale raggiungibile all'indirizzo https://www.hoomie.it, la web app accessibile all'indirizzo https://app.hoomie.it, lo strumento di questionario disponibile all'indirizzo https://quiz.hoomie.it, nonché le applicazioni mobili Hoomie distribuite per i sistemi operativi iOS e Android (congiuntamente, la “Piattaforma”).
Il testo vigente dei Termini è pubblicato all'indirizzo stabile https://privacy.hoomie.it/termini.html, unitamente all'Informativa Privacy e alla Cookie Policy, ed è richiamato da ogni sezione del servizio. I presenti Termini costituiscono il documento unico applicabile a tutte le aree della Piattaforma, comprese quelle di Hoomie Community, e sostituiscono integralmente le condizioni pubblicate in precedenza per singole sezioni del prodotto. Le condizioni così sostituite sono ritirate dalla pubblicazione contestualmente all'entrata in vigore della presente versione: nessun altro testo regola il rapporto fra la Società e l'utente, e ogni copia residua eventualmente ancora raggiungibile deve intendersi superata e priva di effetto.
La registrazione di un account, la pubblicazione di un annuncio, l'invio di una candidatura, o più in generale qualsiasi utilizzo della Piattaforma che ecceda la semplice consultazione delle pagine pubbliche del sito istituzionale, comportano l'accettazione integrale dei Termini. L'utente che non intenda accettarli deve astenersi dall'utilizzare il servizio. Al momento della registrazione la Società registra la versione dei Termini accettata e la data dell'accettazione, a fini di prova e di gestione delle successive modifiche.
I presenti Termini costituiscono, per la parte relativa ai servizi di intermediazione, le condizioni generali richieste dall'articolo 14 del Regolamento (UE) 2022/2065 del Parlamento europeo e del Consiglio del 19 ottobre 2022, relativo a un mercato unico dei servizi digitali (di seguito il “Regolamento sui servizi digitali”), applicabile a tutti i prestatori di servizi intermediari a decorrere dal 17 febbraio 2024.
Ai fini dei presenti Termini, salvo che il contesto non richieda diversamente, le espressioni che seguono hanno il significato qui indicato.
“Account” indica il profilo personale creato dall'utente per accedere alle funzionalità riservate della Piattaforma.
“Annuncio” indica l'inserzione con cui un utente propone un alloggio, una stanza, o un posto letto ad altri utenti, corredata di indirizzo, prezzo richiesto, caratteristiche dell'immobile, immagini, ed eventuale descrizione testuale.
“Candidatura” indica la manifestazione di interesse che un utente rivolge a un Annuncio o a una Ciurma attraverso le funzioni della Piattaforma.
“Ciurma” indica il gruppo di utenti costituito all'interno della Piattaforma per la ricerca congiunta di un alloggio condiviso, al quale si accede su invito o mediante codice.
“Contenuto Utente” indica ogni testo, immagine, fotografia, video, registrazione audio, dato, o altro materiale caricato, trasmesso, o comunque reso disponibile dall'utente attraverso la Piattaforma, ivi compresi i messaggi scambiati in chat.
“Hoomie Community” indica il ramo di prodotto dedicato alle iniziative sociali, agli eventi, ai luoghi segnalati agli utenti (gli “Spot”), alle relative valutazioni, e agli strumenti di coordinamento della convivenza descritti all'articolo 11.
“Gruppo di Convivenza” indica l'insieme degli utenti che condividono un alloggio e che utilizzano congiuntamente gli strumenti di coordinamento resi disponibili nell'area di Hoomie Community.
“Matching” indica il procedimento automatizzato con cui la Piattaforma calcola un indice di compatibilità fra utenti, ovvero fra un utente e un Annuncio.
“Modello Contrattuale” indica il testo standard, non redatto per il caso concreto, che la Piattaforma può mettere a disposizione degli utenti in forma compilabile o scaricabile, secondo quanto previsto dall'articolo 12.
“Utente” indica la persona fisica che accede alla Piattaforma, sia essa registrata o meno.
“Utente Consumatore” indica l'Utente che agisce per scopi estranei all'attività imprenditoriale, commerciale, artigianale, o professionale eventualmente svolta, ai sensi dell'articolo 3, comma 1, lettera a), del decreto legislativo 6 settembre 2005, n. 206 (di seguito il “Codice del Consumo”).
Hoomie mette a disposizione degli utenti uno strumento tecnologico che agevola l'incontro fra chi cerca un alloggio, chi offre un alloggio, e chi desidera individuare persone con cui condividerlo. Le funzioni principali comprendono la creazione di un profilo, la pubblicazione e la consultazione di Annunci, il calcolo automatizzato di indici di compatibilità, la costituzione di Ciurme, lo scambio di messaggi fra utenti, la partecipazione alle iniziative di Hoomie Community, e gli strumenti di coordinamento della convivenza.
Sotto il profilo giuridico la Società opera quale prestatore di un servizio di memorizzazione di informazioni, ai sensi dell'articolo 3, lettera g), punto iii), del Regolamento sui servizi digitali, e quale fornitore di piattaforma online ai sensi dell'articolo 3, lettera i), del medesimo Regolamento, nella misura in cui i contenuti caricati dagli utenti sono diffusi al pubblico su loro richiesta. Il regime di responsabilità applicabile è quello stabilito dagli articoli 4, 5, e 6 del Regolamento sui servizi digitali; gli articoli da 14 a 17 del decreto legislativo 9 aprile 2003, n. 70, che disciplinavano in precedenza la materia nell'ordinamento interno, sono stati abrogati dall'articolo 3, comma 4, del decreto legislativo 25 marzo 2024, n. 50.
Hoomie non svolge attività di mediazione immobiliare ai sensi della legge 3 febbraio 1989, n. 39, non è iscritta nella sezione del repertorio delle notizie economiche e amministrative riservata agli agenti d'affari in mediazione, e non percepisce provvigioni sulla conclusione dei contratti di locazione. La Società non è parte dei contratti che gli utenti eventualmente stipulano fra loro, non presta garanzia sulla loro esecuzione, non custodisce depositi cauzionali, e non interviene nei pagamenti che intercorrono fra le parti. Ogni trattativa, ogni verifica documentale, ogni sopralluogo, e la stipulazione del contratto restano di esclusiva competenza degli utenti interessati.
È fatto divieto di utilizzare la Piattaforma per l'esercizio di attività professionale di mediazione o di gestione immobiliare in mancanza dei titoli abilitativi richiesti dalla legge. L'utente che pubblica Annunci dichiara, all'atto della registrazione e per ciascun Annuncio, di non agire in qualità di agente d'affari in mediazione, e risponde in via esclusiva della veridicità di tale dichiarazione.
Il servizio non costituisce consulenza legale, fiscale, o immobiliare. Le informazioni divulgate attraverso la Piattaforma hanno finalità meramente descrittiva e non sostituiscono la valutazione di un professionista abilitato. La medesima avvertenza vale per i Modelli Contrattuali disciplinati all'articolo 12.
L'accesso alle funzionalità riservate della Piattaforma è consentito alle sole persone fisiche che abbiano compiuto il diciottesimo anno di età e che godano della piena capacità di agire. La scelta risponde alla natura del servizio, che agevola l'instaurazione di rapporti locatizi presupponenti la capacità di obbligarsi validamente.
Il requisito è verificato nel percorso di primo accesso: all'utente è richiesto di indicare la propria data di nascita, sulla quale il sistema calcola l'età, e la registrazione non può essere portata a termine quando il risultato sia inferiore a diciotto anni. Il controllo si fonda sul dato dichiarato dall'utente e non comporta allo stato la verifica di documenti di identità; l'eventuale introduzione di forme di verifica rafforzata sarà preceduta dall'aggiornamento dei presenti Termini e dell'Informativa Privacy.
La dichiarazione di un'età non corrispondente al vero costituisce violazione dei presenti Termini. Qualora la Società accerti che un account è stato creato da un soggetto privo dei requisiti indicati, procede alla chiusura dell'account e alla cancellazione dei relativi dati secondo quanto previsto dall'Informativa Privacy.
L'utilizzo della Piattaforma è consentito per finalità personali e non professionali. Restano salve le ipotesi in cui la Società autorizzi espressamente e per iscritto un utilizzo diverso.
La registrazione avviene mediante indirizzo di posta elettronica e password, ovvero attraverso i servizi di autenticazione federata “Accedi con Google” e “Accedi con Apple”. L'utente si impegna a fornire dati esatti, completi, e aggiornati, e ad aggiornarli tempestivamente in caso di variazione. La creazione di account multipli riferibili alla medesima persona fisica, salvo autorizzazione della Società, non è consentita.
Le credenziali sono personali e non cedibili. L'utente è tenuto a custodirle con la diligenza richiesta dalle circostanze e risponde di ogni attività compiuta attraverso il proprio account, salvo che dimostri l'utilizzo abusivo da parte di terzi non a lui imputabile. In caso di smarrimento, sottrazione, o sospetto accesso non autorizzato, l'utente informa senza ritardo la Società all'indirizzo assistenza@hoomie.it.
La Piattaforma adotta misure tecniche di protezione delle interfacce applicative, fra cui il servizio Firebase App Check, che consente l'accettazione delle richieste provenienti dalle sole istanze legittime dell'applicazione. L'aggiramento di tali misure costituisce violazione dei presenti Termini.
Alla data indicata in apertura del presente documento l'accesso alla Piattaforma e l'utilizzo delle sue funzionalità non comportano il pagamento di alcun corrispettivo in denaro. Nessuna funzione a pagamento risulta attiva, e la Società non richiede né riceve pagamenti dagli utenti attraverso la Piattaforma.
Il rapporto fra la Società e l'Utente Consumatore configura un contratto di fornitura di servizio digitale nel quale il consumatore fornisce dati personali al professionista, secondo la fattispecie disciplinata dall'articolo 135-octies e seguenti del Codice del Consumo, introdotti dal decreto legislativo 4 novembre 2021, n. 173, in attuazione della direttiva (UE) 2019/770. Alla fornitura si applicano pertanto i requisiti di conformità e i rimedi ivi previsti, nei limiti in cui risultino compatibili con la natura gratuita del servizio.
La Società sta valutando l'adozione di un modello misto, nel quale l'insieme delle funzioni oggi disponibili resterebbe accessibile senza corrispettivo e talune funzioni ulteriori, fra cui in ipotesi lo sblocco della messaggistica, sarebbero riservate a chi sottoscriva un piano a pagamento. La previsione è resa nota fin d'ora a scopo di trasparenza e non produce alcun effetto obbligatorio: nessun addebito può essere posto a carico dell'utente in forza della sola presente clausola.
L'attivazione di funzioni a pagamento sarà preceduta da comunicazione agli utenti registrati con il preavviso indicato all'articolo 23 e comporterà la pubblicazione di condizioni economiche specifiche, recanti il prezzo, le imposte applicabili, le modalità e i tempi di pagamento, la durata e il rinnovo dell'eventuale abbonamento, le modalità di disdetta, e la disciplina del diritto di recesso, ivi compresa l'informazione prevista dall'articolo 59, comma 1, lettera o), del Codice del Consumo per il caso in cui l'esecuzione sia richiesta prima della scadenza del termine di recesso. Le condizioni economiche formeranno oggetto di accettazione distinta e specifica: la prosecuzione dell'uso delle funzioni gratuite non vale in alcun caso come adesione a un piano a pagamento.
Fino a quel momento non trova applicazione alcuna procedura di rimborso: non essendo previsto alcun pagamento da parte dell'utente, non sussistono somme rimborsabili. La disciplina dei rimborsi sarà introdotta contestualmente all'attivazione dei servizi a pagamento, unitamente all'aggiornamento dell'Informativa Privacy per la parte relativa al fornitore dei servizi di pagamento.
L'utente conserva ogni diritto di proprietà intellettuale sui Contenuti Utente che carica sulla Piattaforma. Con il caricamento l'utente concede a Hoomie una licenza non esclusiva, gratuita, valida per il territorio necessario all'erogazione del servizio, e limitata alla durata della pubblicazione, per riprodurre, memorizzare, adattare tecnicamente, e rendere visibili i contenuti agli altri utenti nella misura strettamente necessaria al funzionamento della Piattaforma. La licenza comprende le operazioni tecniche di ridimensionamento delle immagini, di transcodifica dei file audio e video, e di generazione delle anteprime di condivisione.
La licenza cessa con la rimozione del contenuto o con la chiusura dell'account, salvo il tempo tecnico necessario alla cancellazione dai sistemi e dalle copie di sicurezza, secondo i termini indicati nell'Informativa Privacy, e salvo che la conservazione sia imposta da un obbligo di legge o risulti necessaria per la difesa di un diritto in sede giudiziaria.
L'utente garantisce di disporre di tutti i diritti necessari sui contenuti caricati, ivi compresi il consenso delle persone eventualmente ritratte in fotografie o riprese video, e l'autorizzazione del titolare dell'immobile per le immagini che lo raffigurano. La Società non esercita un controllo preventivo generalizzato sui contenuti e non è tenuta a svolgerlo, in conformità all'articolo 8 del Regolamento sui servizi digitali.
Non è consentito pubblicare contenuti che risultino illeciti, diffamatori, discriminatori, minatori, osceni, lesivi della riservatezza altrui, ingannevoli, ovvero contrari al buon costume. È del pari vietato pubblicare dati di contatto di terzi senza il loro consenso, materiale pubblicitario non richiesto, catene di messaggi, richieste di pagamento anticipato non riferibili a un rapporto locatizio effettivo, e collegamenti a risorse esterne che veicolino contenuti dannosi.
Chi pubblica un Annuncio dichiara di avere titolo a disporre dell'immobile o della porzione di immobile offerta, a titolo di proprietà, di diritto reale di godimento, di locazione con facoltà di sublocazione, ovvero di mandato conferito dall'avente diritto. La dichiarazione ha efficacia per l'intera durata della pubblicazione e va aggiornata qualora il titolo venga meno.
L'Annuncio deve riportare informazioni veritiere e verificabili quanto a ubicazione, canone richiesto, oneri accessori, dimensione e numero delle stanze offerte, e caratteristiche essenziali dell'alloggio. Le immagini devono raffigurare l'immobile effettivamente proposto. La pubblicazione di Annunci relativi a immobili inesistenti, non disponibili, o descritti in modo difforme dal vero, costituisce violazione grave dei presenti Termini.
Gli Annunci hanno una durata di pubblicazione determinata, decorsa la quale la Piattaforma può disporne la scadenza automatica ovvero il rinnovo, secondo le impostazioni scelte dall'utente. La Società si riserva la facoltà di sospendere o rimuovere gli Annunci che risultino non conformi ai presenti Termini, alla legge, o alle segnalazioni ricevute, secondo la procedura descritta all'articolo 14.
Il canone di locazione, la durata del contratto, il regime fiscale applicabile, e ogni ulteriore condizione economica sono determinati esclusivamente dalle parti. Hoomie non verifica la congruità dei canoni, non attesta la conformità urbanistica o catastale degli immobili, e non certifica l'idoneità abitativa dei locali.
La Piattaforma calcola un indice di compatibilità espresso su una scala da 0 a 100, che misura la corrispondenza fra le preferenze dichiarate dagli utenti. I parametri principali che concorrono al calcolo sono il budget indicato, la città di interesse, la durata della ricerca, la dimensione del gruppo, le abitudini relative al fumo, il grado di socialità dichiarato, le abitudini in materia di pulizia e di ordine domestico, la presenza di animali, e gli indicatori di personalità che l'utente si attribuisce in fase di primo accesso. Nessun parametro di ordinamento è collegato al pagamento di somme da parte degli utenti, poiché il servizio è gratuito e non esistono posizionamenti a pagamento.
L'informazione sui parametri di classificazione è resa in adempimento del principio di trasparenza e, per quanto occorra, in coerenza con l'articolo 49-bis del Codice del Consumo, introdotto dal decreto legislativo 7 marzo 2023, n. 26. Poiché i contratti di locazione non sono conclusi attraverso la Piattaforma, Hoomie non opera quale fornitore di mercato online ai sensi dell'articolo 45, comma 1, del Codice del Consumo; l'informativa sui criteri di ordinamento viene comunque fornita a beneficio degli utenti.
Gli utenti che offrono alloggi sulla Piattaforma sono di regola persone fisiche che agiscono per scopi estranei ad attività professionale. Ne consegue che ai rapporti instaurati fra utenti non si applicano, di norma, le tutele che il diritto dell'Unione europea riserva ai consumatori nei contratti conclusi con professionisti. L'utente è invitato a verificare la qualità della controparte prima di assumere impegni.
L'utente può chiedere in qualsiasi momento l'esclusione dal calcolo automatico di compatibilità attraverso l'apposita impostazione disponibile nell'applicazione, senza che ciò comporti la perdita delle altre funzionalità. La facoltà è descritta anche nell'Informativa Privacy, alla quale si rinvia per la disciplina del trattamento dei dati sottostante.
Le Ciurme consentono a più utenti di coordinarsi nella ricerca di un alloggio condiviso. L'accesso avviene su invito di un membro ovvero mediante l'inserimento di un codice generato dalla Piattaforma. I codici di invito sono personali, hanno validità limitata, e non devono essere diffusi pubblicamente.
All'interno di una Ciurma i membri condividono informazioni relative alle rispettive preferenze di ricerca e possono formulare proposte agli altri componenti. Chi entra in una Ciurma accetta che tali informazioni siano visibili agli altri membri per tutta la durata dell'appartenenza al gruppo. L'uscita da una Ciurma è sempre consentita e interrompe la condivisione delle informazioni per il futuro, fermo restando che i messaggi già scambiati restano visibili nella conversazione ai sensi dell'articolo 13.
Hoomie Community raccoglie le funzioni sociali della Piattaforma. L'adesione è volontaria e non incide sulla fruizione delle restanti funzionalità. Attraverso la sezione l'utente può consultare e proporre eventi, manifestare la propria partecipazione, segnalare Spot, attribuire valutazioni ai luoghi segnalati, e trasmettere suggerimenti alla Società.
Gli eventi pubblicati sono in via ordinaria proposti da utenti o da soggetti terzi. Salvo che sia diversamente e chiaramente indicato, Hoomie non ne è organizzatrice, non ne verifica lo svolgimento, e non risponde della sicurezza dei luoghi, del contenuto delle iniziative, o dei rapporti che si instaurano fra i partecipanti. Le valutazioni e i suggerimenti riflettono l'opinione personale di chi li redige e non costituiscono un'attestazione della Società.
Agli utenti che condividono un alloggio la medesima sezione mette a disposizione strumenti di coordinamento della vita domestica, e in particolare la registrazione delle spese comuni con la ripartizione delle quote fra i conviventi, l'assegnazione dei turni e delle attività domestiche, la compilazione di elenchi di acquisto, e l'archiviazione di documenti in uno spazio condiviso. Accanto agli strumenti condivisi ciascun utente dispone di una rubrica nella quale annotare i recapiti di operatori esterni, alla quale si applica la disciplina particolare esposta nel seguito del presente articolo.
Gli strumenti indicati assolvono a una funzione di calcolo, di annotazione, e di promemoria fra i conviventi. Hoomie non riceve, non detiene, e non trasferisce somme di denaro: i saldi e i rimborsi sono regolati direttamente fra gli utenti, con mezzi da essi scelti e al di fuori della Piattaforma. Gli importi elaborati dal sistema non hanno valore di ricevuta, di quietanza, o di prova del pagamento, e non producono alcun obbligo a carico della Società.
La rubrica dei recapiti di operatori esterni è compilata dal singolo utente per proprio uso. Nella configurazione attiva alla data indicata in apertura del presente documento le annotazioni restano visibili al solo utente che le ha inserite, non sono condivise con gli altri componenti del Gruppo di Convivenza, e non formano oggetto di elenchi predisposti o suggeriti dalla Società. L'eventuale estensione della funzione alla condivisione fra conviventi, ovvero alla segnalazione di operatori selezionati dalla Società, sarà preceduta da comunicazione agli utenti registrati e dall'aggiornamento dell'Informativa Privacy.
Chi inserisce dati nell'area di coordinamento risponde della loro esattezza e liceità. Chi carica un documento garantisce di averne la disponibilità e di non ledere diritti altrui; chi annota il recapito di un operatore esterno dichiara di essere legittimato a farlo e assume gli obblighi che ne discendono nei confronti del soggetto indicato. I contenuti inseriti negli strumenti condivisi sono visibili agli altri componenti del Gruppo di Convivenza per tutta la durata della partecipazione, mentre le annotazioni della rubrica restano riservate al loro autore.
La Società può rimuovere i contenuti presenti nell'area di coordinamento e limitare l'accesso alla sezione, secondo la procedura e con le garanzie previste dall'articolo 14. Le controversie che insorgano fra conviventi in ordine alle spese, ai turni, o ai beni comuni restano estranee al rapporto fra l'utente e la Società.
La Piattaforma può mettere a disposizione degli utenti Modelli Contrattuali compilabili e scaricabili, destinati a facilitare la redazione degli accordi che gli utenti stipulano fra loro. Alla data indicata in apertura la funzione non è attiva; la sua attivazione sarà preceduta da comunicazione agli utenti registrati.
I Modelli Contrattuali sono testi standard, predisposti in via generale e non riferiti alla situazione concreta delle parti. La loro messa a disposizione non costituisce attività di consulenza legale né di assistenza legale stragiudiziale ai sensi dell'articolo 2, comma 6, della legge 31 dicembre 2012, n. 247, non instaura alcun rapporto professionale fra la Società e l'utente, e non comporta alcuna valutazione della vicenda dedotta dalle parti.
Hoomie non è parte degli accordi conclusi mediante l'utilizzo di un Modello Contrattuale, non li sottoscrive, non li conserva quale depositaria, e non ne garantisce la validità, la completezza, o l'idoneità al risultato perseguito dalle parti. Prima di ogni scaricamento è mostrata un'avvertenza in tal senso, la cui presa d'atto costituisce condizione per l'utilizzo della funzione.
Alle parti è raccomandato di sottoporre il testo a un professionista abilitato prima della sottoscrizione. Restano in ogni caso a carico esclusivo delle parti gli adempimenti fiscali e amministrativi connessi al contratto, fra cui la registrazione presso l'Agenzia delle Entrate: si ricorda che l'articolo 1, comma 346, della legge 30 dicembre 2004, n. 311, commina la nullità dei contratti di locazione di unità immobiliari che, ricorrendone i presupposti, non siano registrati. Secondo l'orientamento delle Sezioni Unite della Corte di cassazione, espresso nella sentenza 9 ottobre 2017, n. 23601, la nullità derivante dalla sola omessa registrazione può essere rimossa dalla registrazione tardiva, i cui effetti risalgono alla stipulazione, purché il canone indicato nel contratto corrisponda a quello effettivamente pattuito.
La responsabilità della Società resta limitata alla corretta erogazione tecnica della funzione di compilazione e di scaricamento, nei termini stabiliti dall'articolo 22.
La Piattaforma mette a disposizione un sistema di messaggistica riservato agli utenti registrati. Le conversazioni sono destinate esclusivamente alle finalità del servizio e non possono essere utilizzate per l'invio di comunicazioni commerciali non richieste, per la promozione di prodotti o servizi estranei, o per il contatto insistente di utenti che abbiano manifestato l'intenzione di interrompere lo scambio.
I messaggi restano visibili alle parti della conversazione secondo quanto indicato nell'Informativa Privacy. Personale autorizzato della Società può accedere al contenuto delle conversazioni nei soli casi di gestione di una segnalazione, di assistenza richiesta dall'utente, di adempimento di un obbligo di legge, o di riscontro a una richiesta dell'autorità competente. Gli accessi sono limitati al personale espressamente incaricato e sono tracciati.
Ogni utente è invitato a mantenere la trattativa e lo scambio di documenti all'interno di canali verificabili, a diffidare delle richieste di versamento di somme prima di avere visionato l'immobile e verificato l'identità della controparte, e a segnalare senza indugio i comportamenti sospetti attraverso le funzioni descritte all'articolo 14.
Chiunque può segnalare alla Società la presenza sulla Piattaforma di contenuti che ritenga illegali, utilizzando la funzione di segnalazione disponibile nell'applicazione ovvero scrivendo all'indirizzo assistenza@hoomie.it. Il meccanismo è predisposto in attuazione dell'articolo 16 del Regolamento sui servizi digitali.
Affinché la segnalazione consenta a un operatore diligente di valutare il carattere illegale del contenuto senza un esame giuridico approfondito, essa deve contenere una spiegazione sufficientemente motivata delle ragioni dell'asserita illegalità, l'indicazione esatta della collocazione elettronica del contenuto, il nome e l'indirizzo di posta elettronica del segnalante, salvo che la segnalazione riguardi i reati di cui agli articoli da 3 a 7 della direttiva 2011/93/UE, e una dichiarazione con cui il segnalante conferma il proprio convincimento in buona fede circa l'esattezza di quanto rappresentato.
Alla ricezione di una segnalazione corredata dei recapiti del segnalante la Società invia senza indebito ritardo una conferma di ricevimento. Le segnalazioni sono trattate in modo tempestivo, diligente, non arbitrario, e obiettivo. Ove nel trattamento o nella decisione siano impiegati strumenti automatizzati, la circostanza è comunicata al segnalante unitamente alla decisione adottata.
La Piattaforma impiega sistemi automatici di rilevamento di espressioni offensive, di messaggi indesiderati, e di tentativi di frode informatica. La rilevazione automatica non determina in via autonoma la rimozione di un contenuto: essa produce la segnalazione del contenuto a una coda di revisione, all'esito della quale la decisione è assunta da personale incaricato.
Accertata una violazione, la Società può adottare, secondo criteri di proporzionalità e tenuto conto della gravità e della reiterazione della condotta, la rimozione o la disabilitazione dell'accesso al contenuto, la sospensione temporanea della pubblicazione di annunci, l'emissione di un avvertimento, la limitazione dell'accesso a singole funzionalità, la sospensione dell'account, ovvero la sua chiusura definitiva. Il sistema di avvertimenti progressivi prevede che al terzo avvertimento consegua la sospensione automatica dell'account.
Quando la Società impone una restrizione, ne comunica all'utente interessato la motivazione, ai sensi dell'articolo 17 del Regolamento sui servizi digitali. La motivazione indica il tipo di restrizione, il suo ambito territoriale e la sua durata, i fatti e le circostanze considerati, l'eventuale ricorso a strumenti automatizzati, il riferimento al fondamento giuridico ovvero alla clausola contrattuale violata, e le possibilità di contestazione della decisione.
Hoomie si qualifica allo stato come piccola impresa ai sensi della raccomandazione 2003/361/CE della Commissione del 6 maggio 2003, avendo verificato di occupare meno di cinquanta persone e di non superare la soglia dei dieci milioni di euro quanto al totale di bilancio annuo. Ne consegue l'applicazione dell'esclusione prevista dall'articolo 19 del Regolamento sui servizi digitali dagli obblighi stabiliti dalla sezione 3 del capo III del medesimo Regolamento, fra i quali rientrano il sistema interno di gestione dei reclami, la risoluzione extragiudiziale delle controversie di cui all'articolo 21, e le misure contro gli abusi di cui all'articolo 23. L'esclusione non si estende all'articolo 24, paragrafo 3, in forza del quale la Società comunica al Coordinatore dei servizi digitali e alla Commissione europea, su loro richiesta e senza indebito ritardo, il dato relativo al numero medio mensile di destinatari attivi del servizio nell'Unione.
Restano applicabili alla Società gli obblighi previsti dalle sezioni 1 e 2 del capo III, fra cui quelli in materia di punti di contatto, di condizioni generali, di meccanismi di segnalazione e azione, e di motivazione delle decisioni, con la sola eccezione della relazione periodica sulla trasparenza di cui all'articolo 15, paragrafo 1, dalla quale le piccole imprese sono esonerate a norma del paragrafo 2 del medesimo articolo. Il venir meno della qualifica comporterà l'applicazione integrale della sezione 3 decorsi dodici mesi.
Su base volontaria, e senza che ciò comporti assunzione di obblighi ulteriori rispetto a quelli di legge, la Società mette a disposizione una procedura di riesame. L'utente destinatario di una restrizione, così come il segnalante la cui segnalazione sia stata respinta, può contestare la decisione scrivendo all'indirizzo assistenza@hoomie.it entro sei mesi dalla comunicazione, esponendo le ragioni della contestazione. La Società riesamina la decisione con l'intervento di personale che non abbia partecipato alla decisione originaria, ove ciò risulti organizzativamente possibile, e comunica l'esito in forma motivata. La procedura non pregiudica i rimedi giurisdizionali spettanti all'interessato.
Del pari su base volontaria la Società adotta misure a presidio del corretto funzionamento dei meccanismi di segnalazione e di contestazione, e può sospendere per un periodo ragionevole il trattamento delle segnalazioni provenienti da soggetti che ne facciano un uso manifestamente infondato e ripetuto, previo avvertimento.
Qualora dalla gestione di una segnalazione emergano elementi che inducano a sospettare che sia stato commesso, sia in corso di commissione, o sia probabile che venga commesso un reato che comporti una minaccia per la vita o per la sicurezza di una o più persone, la Società informa senza ritardo le autorità competenti, in attuazione dell'articolo 18 del Regolamento sui servizi digitali.
Ai sensi dell'articolo 11 del Regolamento sui servizi digitali, la Società designa quale punto di contatto unico per le comunicazioni con le autorità degli Stati membri, con la Commissione europea, e con il Comitato europeo per i servizi digitali, l'indirizzo di posta elettronica assistenza@hoomie.it. Le comunicazioni possono essere redatte in lingua italiana o in lingua inglese.
Ai sensi dell'articolo 12 del medesimo Regolamento, il punto di contatto destinato ai destinatari del servizio, che consente di comunicare direttamente e rapidamente con la Società per via elettronica in modo agevole, è il medesimo indirizzo, unitamente alle funzioni di assistenza disponibili all'interno dell'applicazione. La Società non ricorre esclusivamente a strumenti automatizzati per la gestione di tali comunicazioni.
L'autorità nazionale competente in qualità di Coordinatore dei servizi digitali per l'Italia è l'Autorità per le garanzie nelle comunicazioni, designata dall'articolo 15 del decreto-legge 15 settembre 2023, n. 123, convertito con modificazioni dalla legge 13 novembre 2023, n. 159, ai sensi dell'articolo 49, paragrafo 2, del Regolamento sui servizi digitali.
L'utente può cancellare il proprio account in qualsiasi momento attraverso la funzione dedicata disponibile nell'applicazione, ovvero seguendo le istruzioni pubblicate all'indirizzo https://privacy.hoomie.it/elimina-account.html. La cancellazione determina l'avvio di una procedura che rimuove a cascata i dati associati all'account, secondo i tempi e le eccezioni indicati nell'Informativa Privacy, e produce la conservazione di un registro immutabile dell'operazione, in attuazione del principio di responsabilizzazione sancito dall'articolo 5, paragrafo 2, del Regolamento (UE) 2016/679.
La Società può sospendere o chiudere l'account nei casi di violazione grave o reiterata dei presenti Termini, di condotte che pongano a rischio la sicurezza degli altri utenti o l'integrità del servizio, di fornitura di dati non veritieri, di uso della Piattaforma per finalità illecite, o di ordine dell'autorità competente. Salvi i casi di urgenza o di ordine dell'autorità, la chiusura è preceduta da una comunicazione motivata e dalla possibilità per l'utente di fornire chiarimenti.
I profili degli utenti che non accedano alla Piattaforma per un periodo superiore a novanta giorni sono resi non visibili agli altri utenti, senza che ciò comporti la cancellazione dei dati. Il ripristino della visibilità avviene con il nuovo accesso. Decorsi settecentotrenta giorni di inattività la Società procede alla cancellazione definitiva dell'account, con un margine tecnico di trenta giorni per il completamento dell'operazione.
La cessazione del rapporto, per qualunque causa intervenuta, non pregiudica le clausole che per loro natura sono destinate a sopravvivere, fra cui quelle in materia di proprietà intellettuale, di limitazione di responsabilità, di manleva, di legge applicabile, e di foro competente.
Il marchio Hoomie, il nome a dominio, il logo, l'interfaccia grafica, i testi editoriali, le banche dati, il codice sorgente delle applicazioni, e ogni altro elemento della Piattaforma sono di titolarità di Hoomie S.r.l. ovvero dei rispettivi licenzianti, e sono protetti dalla legge 22 aprile 1941, n. 633, sulla protezione del diritto d'autore e di altri diritti connessi al suo esercizio, nonché dalla normativa in materia di marchi e di segni distintivi.
L'accettazione dei presenti Termini non trasferisce all'utente alcun diritto sui predetti elementi e conferisce unicamente il diritto, non esclusivo e non trasferibile, di utilizzare la Piattaforma secondo le sue finalità. Sono vietate la riproduzione, la modifica, la decompilazione, l'estrazione sistematica di dati anche mediante strumenti automatizzati, e ogni forma di utilizzo commerciale non autorizzato. Il Modello Contrattuale scaricato può essere utilizzato dall'utente per il proprio rapporto e non può essere diffuso, ceduto, o commercializzato.
La Società rispetta la proprietà intellettuale altrui e richiede agli utenti di fare altrettanto. Chi ritenga che un contenuto pubblicato sulla Piattaforma violi un proprio diritto d'autore o un diritto connesso può inviare una segnalazione all'indirizzo assistenza@hoomie.it.
La segnalazione deve contenere l'identificazione dell'opera o del materiale protetto che si assume violato, l'indicazione precisa della collocazione del contenuto contestato all'interno della Piattaforma, i dati identificativi e i recapiti del segnalante, l'indicazione del titolo in base al quale il segnalante agisce, sia esso di titolarità originaria, di cessione, o di rappresentanza, e una dichiarazione con cui il segnalante afferma in buona fede che l'utilizzo contestato non è autorizzato dal titolare del diritto, dal suo rappresentante, o dalla legge.
Ricevuta una segnalazione conforme, la Società procede secondo la disciplina descritta all'articolo 14, dandone comunicazione all'utente che ha caricato il contenuto, il quale può fornire elementi contrari, fra cui la prova della titolarità del diritto o della sussistenza di un'eccezione o di una limitazione previste dalla legge sul diritto d'autore. La Società può rimuovere o disabilitare l'accesso al contenuto in attesa dell'esito del contraddittorio, qualora la segnalazione appaia fondata a un esame ragionevole.
La reiterata pubblicazione di contenuti che violano diritti di terzi comporta l'applicazione delle misure di cui all'articolo 14, ivi compresa la chiusura dell'account. Resta impregiudicata la facoltà del titolare del diritto di rivolgersi all'autorità giudiziaria, ovvero di attivare i procedimenti a tutela del diritto d'autore sulle reti di comunicazione elettronica di competenza dell'Autorità per le garanzie nelle comunicazioni, disciplinati dal regolamento allegato alla delibera n. 680/13/CONS del 12 dicembre 2013 e successive modificazioni.
La Società persegue la continuità del servizio con la diligenza tecnica richiesta dallo stato dell'arte, senza tuttavia garantire che l'accesso avvenga in modo ininterrotto e privo di difetti. Interruzioni possono derivare da interventi di manutenzione programmata, da aggiornamenti, da malfunzionamenti delle infrastrutture dei fornitori terzi, o da eventi non imputabili alla Società.
Ove ragionevolmente possibile, gli interventi programmati che comportino una sospensione prolungata sono annunciati in anticipo attraverso i canali informativi della Piattaforma. La Società si riserva la facoltà di modificare, aggiungere, o dismettere singole funzionalità, dandone comunicazione agli utenti quando la modifica incida in modo significativo sulle prestazioni essenziali del servizio.
L'utilizzo della Piattaforma richiede un dispositivo compatibile, una connessione di rete, e, per le applicazioni mobili, una versione del sistema operativo supportata. Gli oneri di connettività restano a carico dell'utente secondo le condizioni pattuite con il proprio operatore.
La Società fornisce il servizio digitale in conformità alla descrizione contenuta nei presenti Termini e alle caratteristiche che l'Utente Consumatore può ragionevolmente attendersi, tenuto conto della natura gratuita della fornitura, secondo i requisiti soggettivi e oggettivi di conformità stabiliti dagli articoli 135-octies e seguenti del Codice del Consumo.
In caso di difetto di conformità l'Utente Consumatore ha diritto al ripristino della conformità del servizio. Nei casi in cui il ripristino risulti impossibile, eccessivamente oneroso, o non venga eseguito entro un termine ragionevole, l'Utente Consumatore può esercitare i rimedi previsti dalla legge nei limiti della loro compatibilità con la fornitura non onerosa. La segnalazione del difetto di conformità va indirizzata a assistenza@hoomie.it.
Le presenti disposizioni non pregiudicano i diritti inderogabili che la legge riconosce all'Utente Consumatore, i quali prevalgono su qualsiasi clausola con essi contrastante.
Il contratto concluso con l'Utente Consumatore costituisce un contratto a distanza avente per oggetto la fornitura di un servizio digitale. La disciplina dei diritti dei consumatori nei contratti a distanza contenuta nel Codice del Consumo è stata estesa, dal decreto legislativo 7 marzo 2023, n. 26, anche ai contratti nei quali il consumatore fornisce dati personali in luogo del pagamento di un prezzo, e trova pertanto applicazione al rapporto qui regolato.
L'Utente Consumatore può recedere dal contratto entro quattordici giorni dalla sua conclusione, senza obbligo di motivazione e senza sostenere alcun costo. Il recesso si esercita cancellando l'account attraverso la funzione dedicata disponibile nell'applicazione, ovvero inviando una dichiarazione esplicita all'indirizzo assistenza@hoomie.it. Ai fini del rispetto del termine è sufficiente che la comunicazione sia inviata prima della sua scadenza.
Poiché la fornitura avviene senza corrispettivo in denaro, l'esercizio del recesso non determina alcun obbligo di restituzione di somme, né alcun addebito a titolo di servizio già fruito. Gli effetti del recesso sul trattamento dei dati personali sono descritti nell'Informativa Privacy.
Indipendentemente dal termine ora indicato, e trattandosi di rapporto a tempo indeterminato, l'utente può porre fine al contratto in qualsiasi momento e senza oneri cancellando il proprio account secondo quanto previsto dall'articolo 16.
La Società risponde dei danni causati da dolo o colpa grave, nonché nei casi in cui la legge esclude la limitazione convenzionale della responsabilità. Nessuna disposizione dei presenti Termini limita la responsabilità per danni alla persona, né i diritti inderogabili dell'Utente Consumatore.
Nei limiti consentiti dall'ordinamento la Società non risponde della veridicità, della completezza, e della liceità dei contenuti pubblicati dagli utenti, dell'esito delle trattative fra utenti, dell'inadempimento dei contratti di locazione o di ospitalità conclusi al di fuori della Piattaforma, della condotta tenuta dagli utenti nei rapporti reciproci, dell'esattezza dei conteggi inseriti nell'area di coordinamento della convivenza, e dei danni derivanti dall'utilizzo di credenziali sottratte per fatto imputabile all'utente. Il regime di esonero da responsabilità del prestatore di servizi di memorizzazione di informazioni è quello previsto dall'articolo 6 del Regolamento sui servizi digitali.
La Società non risponde inoltre delle interruzioni del servizio riconducibili a caso fortuito, a forza maggiore, a provvedimenti dell'autorità, a guasti delle reti di comunicazione elettronica, o a malfunzionamenti delle infrastrutture dei fornitori terzi indicati nell'Informativa Privacy, quando l'evento risulti estraneo alla sfera di controllo della Società e non evitabile con l'ordinaria diligenza.
L'utente tiene indenne la Società da ogni pretesa, azione, o richiesta risarcitoria avanzata da terzi in conseguenza della violazione dei presenti Termini, della legge, o dei diritti altrui a lui imputabile, comprese le spese legali ragionevolmente sostenute per la difesa.
La Società può modificare i presenti Termini per adeguarli a mutamenti normativi, a pronunce delle autorità competenti, a evoluzioni tecniche o funzionali del servizio, ovvero a mutate esigenze organizzative.
Le modifiche sono comunicate agli utenti registrati con un preavviso ragionevole, di regola non inferiore a quindici giorni, mediante avviso all'interno dell'applicazione, messaggio di posta elettronica all'indirizzo associato all'account, o entrambi i canali. La versione aggiornata riporta la data di ultimo aggiornamento ed è resa disponibile sulla Piattaforma e all'indirizzo di pubblicazione indicato all'articolo 1.
L'utente che non intenda accettare le modifiche può cancellare il proprio account prima della data di efficacia, senza oneri. La prosecuzione dell'utilizzo del servizio successivamente a tale data vale come accettazione della nuova versione. Le modifiche imposte da un obbligo di legge o necessarie per la sicurezza del servizio possono avere efficacia immediata, con comunicazione contestuale agli utenti.
In occasione della pubblicazione della presente versione la Società richiede a tutti gli utenti registrati una nuova accettazione della documentazione, così da riferire il consenso al testo vigente.
Il trattamento dei dati personali degli utenti è descritto nell'Informativa Privacy e nella Cookie Policy di Hoomie, che formano parte integrante del quadro contrattuale e sono pubblicate agli indirizzi indicati all'articolo 1. Gli utenti sono invitati a consultarle prima della registrazione.
I presenti Termini sono regolati dalla legge italiana. Restano ferme le disposizioni imperative eventualmente più favorevoli previste dalla legge dello Stato di residenza abituale dell'Utente Consumatore, ai sensi dell'articolo 6 del Regolamento (CE) n. 593/2008 sulla legge applicabile alle obbligazioni contrattuali.
Per le controversie promosse da o nei confronti di un Utente Consumatore la competenza territoriale inderogabile appartiene al giudice del luogo di residenza o di domicilio del consumatore, se ubicati nel territorio dello Stato, ai sensi dell'articolo 66-bis del Codice del Consumo, in coerenza con la presunzione di vessatorietà stabilita dall'articolo 33, comma 2, lettera u), del medesimo Codice. Per le controversie con utenti che non rivestano la qualità di consumatore è competente in via esclusiva il Foro di Cuneo.
Prima di adire l'autorità giudiziaria le parti si impegnano a tentare una composizione amichevole, indirizzando un reclamo scritto e circostanziato all'indirizzo assistenza@hoomie.it. La Società fornisce riscontro entro trenta giorni dal ricevimento.
L'Utente Consumatore può inoltre ricorrere alle procedure di risoluzione alternativa delle controversie disciplinate dagli articoli da 141 a 141-decies del Codice del Consumo, introdotti dal decreto legislativo 6 agosto 2015, n. 130, di attuazione della direttiva 2013/11/UE, rivolgendosi a un organismo iscritto negli elenchi tenuti dalle autorità competenti.
La Società non ha ad oggi aderito in via preventiva ad alcun organismo di risoluzione alternativa delle controversie, e non ricorre pertanto il presupposto dell'obbligo informativo previsto dall'articolo 141-sexies, comma 1, del Codice del Consumo, il quale grava sui professionisti che si siano impegnati a utilizzare uno o più organismi ADR. L'eventuale adesione sarà comunicata mediante aggiornamento dei presenti Termini.
Resta fermo che, qualora un reclamo presentato direttamente alla Società non trovi soluzione, la Società fornisce all'Utente Consumatore, su supporto cartaceo o su altro supporto durevole, le informazioni relative all'organismo o agli organismi competenti a conoscere della controversia, precisando se intenda avvalersene, in adempimento dell'articolo 141-sexies, comma 3, del Codice del Consumo.
Va segnalato che la piattaforma europea di risoluzione delle controversie online non è più operativa. Il regolamento (UE) 2024/3228 del Parlamento europeo e del Consiglio del 19 dicembre 2024, che abroga il regolamento (UE) n. 524/2013 e modifica i regolamenti (UE) 2017/2394 e (UE) 2018/1724 per quanto riguarda la dismissione della piattaforma europea per la risoluzione delle controversie online, ha disposto l'interruzione della presentazione di nuovi reclami a decorrere dal 20 marzo 2025 e l'abrogazione del regolamento (UE) n. 524/2013 con effetto dal 20 luglio 2025. Nessun rinvio a tale piattaforma è pertanto più praticabile, e ogni riferimento a essa eventualmente presente in versioni precedenti della documentazione contrattuale deve intendersi privo di effetto.
Il quadro europeo in materia è destinato a mutare. La direttiva (UE) 2025/2647 del Parlamento europeo e del Consiglio, che modifica la direttiva 2013/11/UE, è stata pubblicata nella Gazzetta ufficiale dell'Unione europea del 30 dicembre 2025 ed è entrata in vigore il 19 gennaio 2026; il suo ambito di applicazione comprende espressamente i contratti nei quali il consumatore fornisce dati personali in luogo del pagamento di un prezzo, categoria alla quale appartiene il rapporto qui regolato. Gli Stati membri sono tenuti ad adottare le disposizioni di recepimento entro il 20 marzo 2028 e ad applicarle a decorrere dal 20 settembre 2028. Prima di tale termine la Società verificherà la necessità di adeguare la presente clausola alla disciplina nazionale di attuazione.
L'eventuale invalidità, nullità, o inefficacia di una singola clausola non travolge le restanti previsioni, che conservano piena efficacia. La clausola invalida è sostituita di diritto dalla disposizione di legge applicabile ovvero, in mancanza, è interpretata nel senso che meglio si avvicina alla volontà originaria delle parti nei limiti consentiti dall'ordinamento.
La tolleranza da parte della Società di comportamenti difformi dai presenti Termini non costituisce rinuncia a farli valere in seguito, né determina modificazione tacita del regolamento contrattuale.
L'utente non può cedere a terzi la propria posizione contrattuale senza il consenso scritto della Società. Hoomie può cedere il contratto nell'ambito di operazioni di trasferimento d'azienda o di ramo d'azienda, di fusione, o di scissione, dandone comunicazione agli utenti e fermo restando il diritto di questi ultimi di cancellare l'account.
Le comunicazioni dirette all'utente si intendono validamente effettuate all'indirizzo di posta elettronica associato all'account ovvero mediante avviso all'interno dell'applicazione. È onere dell'utente mantenere aggiornato il proprio recapito.
I presenti Termini sono redatti in lingua italiana, che costituisce l'unica versione facente fede. Eventuali traduzioni in altre lingue hanno valore di mera cortesia e, in caso di discordanza, prevale il testo italiano.

These Terms and Conditions of Use (the "Terms") govern access to and use of the Hoomie platform by users. The service is operated by Hoomie S.r.l., a company incorporated under Italian law, with registered office at Via Pier Carlo Boggio 41, 12100 Cuneo (CN), Italy, tax code and VAT number 04175400045 ("Hoomie" or the "Company"). For any communication relating to the service the user may write to assistenza@hoomie.it; for corporate and institutional communications the address info@hoomie.it is available.
The platform comprises the institutional website reachable at https://www.hoomie.it, the web app accessible at https://app.hoomie.it, the questionnaire tool available at https://quiz.hoomie.it, as well as the Hoomie mobile applications distributed for the iOS and Android operating systems (together, the "Platform").
The text of the Terms in force is published at the stable address https://privacy.hoomie.it/termini.html, together with the Privacy Notice and the Cookie Policy, and is referred to by every section of the service. These Terms constitute the single document applicable to all areas of the Platform, including those of Hoomie Community, and entirely replace the conditions previously published for individual sections of the product. The conditions thus replaced are withdrawn from publication upon the entry into force of this version: no other text governs the relationship between the Company and the user, and any residual copy that may still be reachable is to be regarded as superseded and of no effect.
Registering an account, publishing a listing, sending an application, or more generally any use of the Platform that goes beyond the mere consultation of the public pages of the institutional website, entail the full acceptance of the Terms. A user who does not intend to accept them must refrain from using the service. At the time of registration the Company records the version of the Terms accepted and the date of acceptance, for the purposes of proof and of managing subsequent changes.
These Terms constitute, as regards the part relating to intermediation services, the general conditions required by Article 14 of Regulation (EU) 2022/2065 of the European Parliament and of the Council of 19 October 2022 on a Single Market for Digital Services (the "Digital Services Act"), applicable to all providers of intermediary services from 17 February 2024.
For the purposes of these Terms, unless the context requires otherwise, the following expressions have the meaning indicated here.
"Account" means the personal profile created by the user to access the reserved features of the Platform.
"Listing" means the advertisement by which a user offers accommodation, a room, or a bed to other users, accompanied by address, requested price, features of the property, images, and any text description.
"Application" means the expression of interest that a user addresses to a Listing or to a Crew through the Platform's functions.
"Crew" (Ciurma) means the group of users formed within the Platform for the joint search for shared accommodation, joined by invitation or by code.
"User Content" means any text, image, photograph, video, audio recording, data, or other material uploaded, transmitted, or otherwise made available by the user through the Platform, including the messages exchanged in chat.
"Hoomie Community" means the product branch dedicated to social initiatives, events, places recommended to users (the "Spots"), the related ratings, and the household-coordination tools described in Article 11.
"Cohabitation Group" means the set of users who share accommodation and jointly use the coordination tools made available in the Hoomie Community area.
"Matching" means the automated process by which the Platform calculates a compatibility index between users, or between a user and a Listing.
"Contract Template" means the standard text, not drafted for the specific case, that the Platform may make available to users in fillable or downloadable form, as provided by Article 12.
"User" means the natural person who accesses the Platform, whether registered or not.
"Consumer User" means the User who acts for purposes unrelated to any entrepreneurial, commercial, craft, or professional activity carried out, pursuant to Article 3(1)(a) of Legislative Decree no. 206 of 6 September 2005 (the "Consumer Code").
Hoomie makes available to users a technological tool that facilitates the meeting between those seeking accommodation, those offering accommodation, and those wishing to identify people to share it with. The main functions include the creation of a profile, the publication and consultation of Listings, the automated calculation of compatibility indices, the formation of Crews, the exchange of messages between users, participation in Hoomie Community initiatives, and the household-coordination tools.
From a legal standpoint the Company operates as a provider of a hosting service, within the meaning of Article 3(g)(iii) of the Digital Services Act, and as a provider of an online platform within the meaning of Article 3(i) of the same Regulation, insofar as the content uploaded by users is disseminated to the public at their request. The applicable liability regime is that established by Articles 4, 5, and 6 of the Digital Services Act; Articles 14 to 17 of Legislative Decree no. 70 of 9 April 2003, which previously governed the matter in domestic law, have been repealed by Article 3(4) of Legislative Decree no. 50 of 25 March 2024.
Hoomie does not carry out real-estate brokerage activity within the meaning of Law no. 39 of 3 February 1989, is not registered in the section of the register of economic and administrative information reserved to real-estate brokers, and does not receive commissions on the conclusion of lease contracts. The Company is not a party to the contracts that users may enter into with one another, provides no guarantee as to their performance, holds no security deposits, and does not intervene in the payments between the parties. Every negotiation, every documentary check, every inspection, and the conclusion of the contract remain the exclusive responsibility of the users concerned.
It is prohibited to use the Platform for the professional exercise of brokerage or property-management activity in the absence of the qualifications required by law. The user who publishes Listings declares, upon registration and for each Listing, that they do not act as a real-estate broker, and is exclusively responsible for the truthfulness of that declaration.
The service does not constitute legal, tax, or real-estate advice. The information disclosed through the Platform is merely descriptive and does not replace the assessment of a qualified professional. The same warning applies to the Contract Templates governed by Article 12.
Access to the reserved features of the Platform is permitted only to natural persons who have reached the age of eighteen and who have full legal capacity to act. This choice reflects the nature of the service, which facilitates the establishment of leasing relationships presupposing the capacity to bind oneself validly.
The requirement is verified in the first-access flow: the user is asked to indicate their date of birth, on which the system calculates the age, and registration cannot be completed where the result is below eighteen. The check is based on the data declared by the user and does not currently entail the verification of identity documents; the possible introduction of enhanced verification methods will be preceded by the updating of these Terms and of the Privacy Notice.
Declaring an age that does not correspond to the truth constitutes a breach of these Terms. Where the Company establishes that an account has been created by a person lacking the indicated requirements, it closes the account and deletes the related data as provided by the Privacy Notice.
Use of the Platform is permitted for personal, non-professional purposes. The cases in which the Company expressly authorises a different use in writing remain unaffected.
Registration takes place by email address and password, or through the federated authentication services "Sign in with Google" and "Sign in with Apple". The user undertakes to provide accurate, complete, and up-to-date data, and to update them promptly in the event of change. The creation of multiple accounts attributable to the same natural person, save with the Company's authorisation, is not permitted.
Credentials are personal and non-transferable. The user must keep them with the diligence required by the circumstances and is responsible for any activity carried out through their account, unless they prove misuse by third parties not attributable to them. In the event of loss, theft, or suspected unauthorised access, the user informs the Company without delay at assistenza@hoomie.it.
The Platform adopts technical measures to protect the application interfaces, including the Firebase App Check service, which allows requests to be accepted only from legitimate instances of the application. Circumventing such measures constitutes a breach of these Terms.
As at the date indicated at the top of this document, access to the Platform and use of its features do not entail the payment of any monetary consideration. No paid feature is active, and the Company neither requests nor receives payments from users through the Platform.
The relationship between the Company and the Consumer User constitutes a contract for the supply of a digital service in which the consumer provides personal data to the trader, according to the case governed by Article 135-octies et seq. of the Consumer Code, introduced by Legislative Decree no. 173 of 4 November 2021, implementing Directive (EU) 2019/770. The conformity requirements and the remedies provided therein therefore apply to the supply, to the extent that they are compatible with the gratuitous nature of the service.
The Company is considering the adoption of a mixed model, in which the set of functions available today would remain accessible without consideration and certain further functions, including hypothetically the unlocking of messaging, would be reserved to those who subscribe to a paid plan. This provision is made known from now on for the sake of transparency and produces no binding effect: no charge may be imposed on the user by virtue of this clause alone.
The activation of paid features will be preceded by a communication to registered users with the notice period indicated in Article 23 and will entail the publication of specific economic conditions, stating the price, the applicable taxes, the methods and timing of payment, the duration and renewal of any subscription, the cancellation methods, and the rules on the right of withdrawal, including the information provided by Article 59(1)(o) of the Consumer Code for the case in which performance is requested before the expiry of the withdrawal period. The economic conditions will be subject to distinct and specific acceptance: the continued use of the free functions in no case amounts to subscription to a paid plan.
Until then no refund procedure applies: as no payment by the user is provided for, there are no refundable sums. The rules on refunds will be introduced together with the activation of the paid services, along with the updating of the Privacy Notice as regards the payment-services provider.
The user retains all intellectual-property rights in the User Content they upload to the Platform. Upon uploading, the user grants Hoomie a non-exclusive, royalty-free licence, valid for the territory necessary for the provision of the service, and limited to the duration of publication, to reproduce, store, technically adapt, and make the content visible to other users to the extent strictly necessary for the operation of the Platform. The licence includes the technical operations of image resizing, audio and video file transcoding, and the generation of sharing previews.
The licence ceases upon the removal of the content or the closure of the account, save for the technical time necessary for deletion from the systems and backups, according to the terms indicated in the Privacy Notice, and save where retention is imposed by a legal obligation or is necessary for the defence of a right in legal proceedings.
The user warrants that they hold all the rights necessary over the uploaded content, including the consent of any persons depicted in photographs or video footage, and the authorisation of the property owner for images depicting it. The Company does not carry out a generalised prior check of content and is not required to do so, in accordance with Article 8 of the Digital Services Act.
It is not permitted to publish content that is unlawful, defamatory, discriminatory, threatening, obscene, harmful to the privacy of others, deceptive, or contrary to public morality. It is likewise prohibited to publish third parties' contact details without their consent, unsolicited advertising material, chain messages, requests for advance payment not referable to an actual leasing relationship, and links to external resources that convey harmful content.
Anyone who publishes a Listing declares that they have title to dispose of the property or portion of property offered, by way of ownership, of a real right of enjoyment, of a lease with the power to sublet, or of a mandate conferred by the entitled party. The declaration is effective for the entire duration of publication and must be updated if the title ceases.
The Listing must state truthful and verifiable information as to location, requested rent, ancillary charges, size and number of the rooms offered, and essential features of the accommodation. The images must depict the property actually offered. The publication of Listings relating to non-existent, unavailable, or misdescribed properties constitutes a serious breach of these Terms.
Listings have a determined duration of publication, after which the Platform may provide for their automatic expiry or renewal, according to the settings chosen by the user. The Company reserves the right to suspend or remove Listings that are found not to comply with these Terms, with the law, or with the reports received, according to the procedure described in Article 14.
The rent, the duration of the contract, the applicable tax regime, and any further economic condition are determined exclusively by the parties. Hoomie does not verify the fairness of the rents, does not attest to the town-planning or cadastral compliance of the properties, and does not certify the habitability of the premises.
The Platform calculates a compatibility index expressed on a scale from 0 to 100, which measures the correspondence between the preferences declared by users. The main parameters that contribute to the calculation are the indicated budget, the city of interest, the search duration, the group size, smoking habits, the declared degree of sociability, habits regarding cleanliness and household tidiness, the presence of animals, and the personality indicators that the user attributes to themselves at first access. No ranking parameter is linked to the payment of sums by users, since the service is free and there are no paid placements.
The information on the ranking parameters is provided in fulfilment of the transparency principle and, for whatever purpose it may serve, in line with Article 49-bis of the Consumer Code, introduced by Legislative Decree no. 26 of 7 March 2023. Since lease contracts are not concluded through the Platform, Hoomie does not operate as an online marketplace provider within the meaning of Article 45(1) of the Consumer Code; the information on the ranking criteria is nonetheless provided for the benefit of users.
The users who offer accommodation on the Platform are as a rule natural persons acting for purposes unrelated to professional activity. It follows that the protections which European Union law reserves to consumers in contracts concluded with traders do not, as a rule, apply to the relationships established between users. The user is invited to verify the quality of the counterparty before undertaking commitments.
The user may at any time request exclusion from the automatic compatibility calculation through the dedicated setting available in the application, without this entailing the loss of the other features. This option is also described in the Privacy Notice, to which reference is made for the rules on the underlying data processing.
Crews allow several users to coordinate in the search for shared accommodation. Access takes place at the invitation of a member or by entering a code generated by the Platform. Invitation codes are personal, have limited validity, and must not be disseminated publicly.
Within a Crew the members share information relating to their respective search preferences and may make proposals to the other members. Anyone who joins a Crew accepts that such information is visible to the other members for the entire duration of membership of the group. Leaving a Crew is always permitted and interrupts the sharing of information for the future, it being understood that the messages already exchanged remain visible in the conversation pursuant to Article 13.
Hoomie Community brings together the social functions of the Platform. Membership is voluntary and does not affect the use of the remaining features. Through the section the user may consult and propose events, express their participation, report Spots, assign ratings to the reported places, and send suggestions to the Company.
The events published are ordinarily proposed by users or by third parties. Unless otherwise clearly indicated, Hoomie is not their organiser, does not verify their conduct, and is not liable for the safety of the venues, the content of the initiatives, or the relationships established between participants. The ratings and suggestions reflect the personal opinion of those who write them and do not constitute an attestation by the Company.
To users who share accommodation, the same section makes available tools for coordinating domestic life, in particular the recording of shared expenses with the allocation of shares among flatmates, the assignment of rotas and household tasks, the compilation of shopping lists, and the storage of documents in a shared space. Alongside the shared tools, each user has an address book in which to record the contacts of external operators, to which the specific rules set out in the remainder of this Article apply.
The tools indicated serve a function of calculation, note-taking, and reminder among flatmates. Hoomie does not receive, hold, or transfer any sums of money: balances and reimbursements are settled directly between users, by means chosen by them and outside the Platform. The amounts processed by the system have no value as a receipt, discharge, or proof of payment, and produce no obligation on the Company.
The address book of external operators' contacts is compiled by the individual user for their own use. In the configuration active as at the date indicated at the top of this document, the entries remain visible only to the user who entered them, are not shared with the other members of the Cohabitation Group, and are not the subject of lists prepared or suggested by the Company. Any extension of the function to sharing among flatmates, or to the recommendation of operators selected by the Company, will be preceded by a communication to registered users and by the updating of the Privacy Notice.
Anyone who enters data in the coordination area is responsible for their accuracy and lawfulness. Anyone who uploads a document warrants that they have the availability of it and do not infringe the rights of others; anyone who records the contact of an external operator declares that they are entitled to do so and assumes the resulting obligations towards the person indicated. The content entered in the shared tools is visible to the other members of the Cohabitation Group for the entire duration of participation, whereas the address-book entries remain reserved to their author.
The Company may remove the content present in the coordination area and restrict access to the section, according to the procedure and with the safeguards provided by Article 14. Disputes that arise between flatmates regarding expenses, rotas, or common goods remain extraneous to the relationship between the user and the Company.
The Platform may make available to users fillable and downloadable Contract Templates, intended to facilitate the drafting of the agreements that users enter into with one another. As at the date indicated at the top, the function is not active; its activation will be preceded by a communication to registered users.
Contract Templates are standard texts, prepared in general terms and not referred to the specific situation of the parties. Making them available does not constitute legal-advisory activity or out-of-court legal assistance within the meaning of Article 2(6) of Law no. 247 of 31 December 2012, establishes no professional relationship between the Company and the user, and entails no assessment of the matter submitted by the parties.
Hoomie is not a party to the agreements concluded through the use of a Contract Template, does not sign them, does not keep them as a depositary, and does not guarantee their validity, completeness, or suitability for the result pursued by the parties. Before each download a warning to this effect is shown, the acknowledgement of which is a condition for using the function.
The parties are recommended to submit the text to a qualified professional before signing. In any case, the tax and administrative obligations connected with the contract remain the exclusive responsibility of the parties, including registration with the Revenue Agency (Agenzia delle Entrate): it is recalled that Article 1(346) of Law no. 311 of 30 December 2004 provides for the nullity of lease contracts of real-estate units which, where the conditions apply, are not registered. According to the position of the Joint Chambers of the Court of Cassation, expressed in judgment no. 23601 of 9 October 2017, the nullity arising from the sole failure to register may be removed by late registration, whose effects date back to the conclusion, provided that the rent indicated in the contract corresponds to that actually agreed.
The Company's liability remains limited to the correct technical provision of the fill-in and download function, on the terms established by Article 22.
The Platform makes available a messaging system reserved to registered users. Conversations are intended solely for the purposes of the service and may not be used for sending unsolicited commercial communications, for the promotion of unrelated products or services, or for the persistent contacting of users who have expressed the intention to interrupt the exchange.
Messages remain visible to the parties to the conversation as indicated in the Privacy Notice. Authorised Company staff may access the content of conversations only in cases of handling a report, of assistance requested by the user, of fulfilment of a legal obligation, or of responding to a request from the competent authority. Access is limited to expressly designated staff and is logged.
Each user is invited to keep the negotiation and the exchange of documents within verifiable channels, to be wary of requests to pay sums before having viewed the property and verified the identity of the counterparty, and to report suspicious behaviour without delay through the functions described in Article 14.
Anyone may report to the Company the presence on the Platform of content they consider illegal, using the reporting function available in the application or by writing to assistenza@hoomie.it. The mechanism is set up in implementation of Article 16 of the Digital Services Act.
In order for the report to enable a diligent operator to assess the illegal nature of the content without an in-depth legal examination, it must contain a sufficiently substantiated explanation of the reasons for the alleged illegality, the exact indication of the electronic location of the content, the name and email address of the reporter, save where the report concerns the offences referred to in Articles 3 to 7 of Directive 2011/93/EU, and a statement by which the reporter confirms their good-faith belief in the accuracy of what is represented.
Upon receipt of a report accompanied by the reporter's contact details, the Company sends without undue delay an acknowledgement of receipt. Reports are handled in a timely, diligent, non-arbitrary, and objective manner. Where automated tools are used in the handling or the decision, this is communicated to the reporter together with the decision taken.
The Platform uses automatic systems to detect offensive expressions, unwanted messages, and attempts at computer fraud. Automatic detection does not autonomously determine the removal of content: it results in the flagging of the content to a review queue, at the end of which the decision is taken by designated staff.
Once a breach is established, the Company may adopt, according to criteria of proportionality and taking account of the seriousness and repetition of the conduct, the removal or disabling of access to the content, the temporary suspension of the publication of listings, the issuing of a warning, the restriction of access to individual features, the suspension of the account, or its definitive closure. The progressive-warning system provides that the third warning results in the automatic suspension of the account.
When the Company imposes a restriction, it communicates to the user concerned the statement of reasons, pursuant to Article 17 of the Digital Services Act. The statement of reasons indicates the type of restriction, its territorial scope and duration, the facts and circumstances considered, any use of automated tools, the reference to the legal basis or to the contractual clause breached, and the possibilities of challenging the decision.
Hoomie currently qualifies as a small enterprise within the meaning of Commission Recommendation 2003/361/EC of 6 May 2003, having verified that it employs fewer than fifty persons and does not exceed the threshold of ten million euro as regards the annual balance-sheet total. It follows that the exemption provided by Article 19 of the Digital Services Act applies from the obligations established by Section 3 of Chapter III of the same Regulation, which include the internal complaint-handling system, the out-of-court dispute settlement under Article 21, and the measures against misuse under Article 23. The exemption does not extend to Article 24(3), by virtue of which the Company communicates to the Digital Services Coordinator and to the European Commission, at their request and without undue delay, the figure relating to the average monthly number of active recipients of the service in the Union.
The obligations provided by Sections 1 and 2 of Chapter III remain applicable to the Company, including those concerning points of contact, general conditions, notice-and-action mechanisms, and the statement of reasons for decisions, with the sole exception of the periodic transparency report under Article 15(1), from which small enterprises are exempted under paragraph 2 of the same Article. The loss of this qualification will entail the full application of Section 3 after twelve months.
On a voluntary basis, and without this entailing the assumption of obligations beyond those imposed by law, the Company makes available a review procedure. A user subject to a restriction, as well as a reporter whose report has been rejected, may challenge the decision by writing to assistenza@hoomie.it within six months of the communication, setting out the reasons for the challenge. The Company reviews the decision with the involvement of staff who did not take part in the original decision, where this is organisationally possible, and communicates the outcome with reasons. The procedure is without prejudice to the judicial remedies available to the person concerned.
Likewise on a voluntary basis, the Company adopts measures to safeguard the proper functioning of the reporting and challenge mechanisms, and may suspend for a reasonable period the handling of reports from persons who make manifestly unfounded and repeated use of them, after a prior warning.
Where the handling of a report reveals elements giving rise to a suspicion that a criminal offence involving a threat to the life or safety of one or more persons has been committed, is being committed, or is likely to be committed, the Company informs the competent authorities without delay, in implementation of Article 18 of the Digital Services Act.
Pursuant to Article 11 of the Digital Services Act, the Company designates as its single point of contact for communications with the authorities of the Member States, with the European Commission, and with the European Board for Digital Services, the email address assistenza@hoomie.it. Communications may be drafted in Italian or in English.
Pursuant to Article 12 of the same Regulation, the point of contact for recipients of the service, allowing direct and rapid communication with the Company by electronic means in an easy manner, is the same address, together with the support functions available within the application. The Company does not rely solely on automated tools for handling such communications.
The national authority competent as Digital Services Coordinator for Italy is the Communications Regulatory Authority (Autorità per le garanzie nelle comunicazioni), designated by Article 15 of Decree-Law no. 123 of 15 September 2023, converted with amendments by Law no. 159 of 13 November 2023, pursuant to Article 49(2) of the Digital Services Act.
The user may delete their account at any time through the dedicated function available in the application, or by following the instructions published at https://privacy.hoomie.it/elimina-account.html. Deletion triggers a procedure that cascadingly removes the data associated with the account, according to the timing and exceptions indicated in the Privacy Notice, and results in the retention of an immutable log of the operation, in implementation of the accountability principle enshrined in Article 5(2) of Regulation (EU) 2016/679.
The Company may suspend or close the account in cases of serious or repeated breach of these Terms, of conduct that endangers the security of other users or the integrity of the service, of provision of untruthful data, of use of the Platform for unlawful purposes, or of order by the competent authority. Save in cases of urgency or of order by the authority, closure is preceded by a reasoned communication and by the possibility for the user to provide clarifications.
The profiles of users who do not access the Platform for a period exceeding ninety days are made invisible to other users, without this entailing the deletion of the data. Visibility is restored upon the next access. After seven hundred and thirty days of inactivity the Company proceeds to the definitive deletion of the account, with a technical margin of thirty days to complete the operation.
The termination of the relationship, for whatever cause, does not affect the clauses which by their nature are intended to survive, including those concerning intellectual property, limitation of liability, indemnity, applicable law, and jurisdiction.
The Hoomie trademark, the domain name, the logo, the graphic interface, the editorial texts, the databases, the source code of the applications, and every other element of the Platform are owned by Hoomie S.r.l. or by the respective licensors, and are protected by Law no. 633 of 22 April 1941 on the protection of copyright and other rights connected with its exercise, as well as by the rules on trademarks and distinctive signs.
Acceptance of these Terms does not transfer to the user any right over the aforementioned elements and confers solely the non-exclusive and non-transferable right to use the Platform in accordance with its purposes. Reproduction, modification, decompilation, the systematic extraction of data including by automated means, and any form of unauthorised commercial use are prohibited. A downloaded Contract Template may be used by the user for their own relationship and may not be disseminated, transferred, or commercialised.
The Company respects the intellectual property of others and requires users to do the same. Anyone who believes that content published on the Platform infringes their copyright or a related right may send a report to assistenza@hoomie.it.
The report must contain the identification of the work or protected material claimed to be infringed, the precise indication of the location of the contested content within the Platform, the identification data and contact details of the reporter, the indication of the title on the basis of which the reporter acts, whether of original ownership, of assignment, or of representation, and a statement by which the reporter affirms in good faith that the contested use is not authorised by the rightholder, by their representative, or by law.
Upon receipt of a compliant report, the Company proceeds according to the rules described in Article 14, giving notice to the user who uploaded the content, who may provide contrary elements, including proof of ownership of the right or of the existence of an exception or limitation provided by copyright law. The Company may remove or disable access to the content pending the outcome of the adversarial procedure, where the report appears well-founded on a reasonable examination.
The repeated publication of content that infringes the rights of third parties entails the application of the measures under Article 14, including the closure of the account. The rightholder's right to apply to the judicial authority remains unaffected, as does the option to activate the procedures for the protection of copyright on electronic communications networks within the competence of the Communications Regulatory Authority, governed by the regulation annexed to resolution no. 680/13/CONS of 12 December 2013 and subsequent amendments.
The Company pursues the continuity of the service with the technical diligence required by the state of the art, without however guaranteeing that access takes place uninterruptedly and free of defects. Interruptions may result from scheduled maintenance, from updates, from malfunctions of third-party providers' infrastructures, or from events not attributable to the Company.
Where reasonably possible, scheduled interventions entailing a prolonged suspension are announced in advance through the Platform's information channels. The Company reserves the right to modify, add, or discontinue individual features, giving notice to users when the change significantly affects the essential performance of the service.
Use of the Platform requires a compatible device, a network connection, and, for the mobile applications, a supported version of the operating system. Connectivity charges remain the user's responsibility according to the conditions agreed with their operator.
The Company provides the digital service in conformity with the description contained in these Terms and with the characteristics that the Consumer User can reasonably expect, taking account of the gratuitous nature of the supply, according to the subjective and objective conformity requirements established by Articles 135-octies et seq. of the Consumer Code.
In the event of a lack of conformity, the Consumer User is entitled to the restoration of the service's conformity. In cases where restoration is impossible, excessively onerous, or is not carried out within a reasonable time, the Consumer User may exercise the remedies provided by law within the limits of their compatibility with the non-onerous supply. The report of the lack of conformity must be addressed to assistenza@hoomie.it.
These provisions do not affect the mandatory rights that the law recognises to the Consumer User, which prevail over any clause conflicting with them.
The contract concluded with the Consumer User constitutes a distance contract for the supply of a digital service. The rules on consumers' rights in distance contracts contained in the Consumer Code have been extended, by Legislative Decree no. 26 of 7 March 2023, also to contracts in which the consumer provides personal data in place of the payment of a price, and therefore apply to the relationship governed here.
The Consumer User may withdraw from the contract within fourteen days of its conclusion, without any obligation to give reasons and without incurring any cost. Withdrawal is exercised by deleting the account through the dedicated function available in the application, or by sending an explicit statement to assistenza@hoomie.it. For the purpose of complying with the deadline, it is sufficient that the communication is sent before its expiry.
Since the supply takes place without monetary consideration, the exercise of withdrawal entails no obligation to return sums, nor any charge for the service already used. The effects of withdrawal on the processing of personal data are described in the Privacy Notice.
Regardless of the deadline now indicated, and this being a relationship of indefinite duration, the user may terminate the contract at any time and without charge by deleting their account as provided by Article 16.
The Company is liable for damage caused by wilful misconduct or gross negligence, as well as in cases where the law excludes the contractual limitation of liability. No provision of these Terms limits liability for personal injury, nor the mandatory rights of the Consumer User.
Within the limits permitted by the legal system, the Company is not liable for the truthfulness, completeness, and lawfulness of the content published by users, for the outcome of negotiations between users, for the non-performance of lease or hospitality contracts concluded outside the Platform, for the conduct of users in their mutual relationships, for the accuracy of the calculations entered in the household-coordination area, and for damage arising from the use of credentials stolen through a fact attributable to the user. The liability-exemption regime of the hosting-service provider is that provided by Article 6 of the Digital Services Act.
The Company is furthermore not liable for interruptions of the service attributable to fortuitous events, force majeure, measures of the authority, failures of electronic communications networks, or malfunctions of the infrastructures of the third-party providers indicated in the Privacy Notice, where the event is outside the Company's sphere of control and unavoidable with ordinary diligence.
The user holds the Company harmless from any claim, action, or request for compensation brought by third parties as a consequence of the breach of these Terms, of the law, or of the rights of others attributable to the user, including the legal costs reasonably incurred for the defence.
The Company may amend these Terms to bring them into line with legislative changes, with rulings of the competent authorities, with technical or functional developments of the service, or with changed organisational needs.
Amendments are communicated to registered users with reasonable notice, as a rule not less than fifteen days, by notice within the application, by email to the address associated with the account, or by both channels. The updated version states the date of the latest update and is made available on the Platform and at the publication address indicated in Article 1.
A user who does not intend to accept the amendments may delete their account before the effective date, without charge. Continued use of the service after that date amounts to acceptance of the new version. Amendments imposed by a legal obligation or necessary for the security of the service may take immediate effect, with contextual communication to users.
On the occasion of the publication of this version, the Company requests all registered users to accept the documentation again, so as to relate the consent to the text in force.
The processing of users' personal data is described in Hoomie's Privacy Notice and Cookie Policy, which form an integral part of the contractual framework and are published at the addresses indicated in Article 1. Users are invited to consult them before registration.
These Terms are governed by Italian law. The mandatory provisions that may be more favourable under the law of the country of habitual residence of the Consumer User remain unaffected, pursuant to Article 6 of Regulation (EC) no. 593/2008 on the law applicable to contractual obligations.
For disputes brought by or against a Consumer User, mandatory territorial jurisdiction belongs to the court of the place of residence or domicile of the consumer, if located within the territory of the State, pursuant to Article 66-bis of the Consumer Code, in line with the presumption of unfairness established by Article 33(2)(u) of the same Code. For disputes with users who do not have the status of consumer, the Court of Cuneo has exclusive jurisdiction.
Before applying to the judicial authority, the parties undertake to attempt an amicable settlement, addressing a written and detailed complaint to assistenza@hoomie.it. The Company responds within thirty days of receipt.
The Consumer User may also resort to the alternative dispute resolution procedures governed by Articles 141 to 141-decies of the Consumer Code, introduced by Legislative Decree no. 130 of 6 August 2015, implementing Directive 2013/11/EU, by turning to a body registered in the lists kept by the competent authorities.
The Company has not to date adhered in advance to any alternative dispute resolution body, and therefore the condition for the information obligation provided by Article 141-sexies(1) of the Consumer Code, which falls on traders who have committed to using one or more ADR bodies, does not apply. Any adhesion will be communicated by updating these Terms.
It remains understood that, where a complaint submitted directly to the Company is not resolved, the Company provides the Consumer User, on paper or on another durable medium, with the information relating to the body or bodies competent to hear the dispute, specifying whether it intends to use them, in fulfilment of Article 141-sexies(3) of the Consumer Code.
It is noted that the European online dispute resolution platform is no longer operational. Regulation (EU) 2024/3228 of the European Parliament and of the Council of 19 December 2024, which repeals Regulation (EU) no. 524/2013 and amends Regulations (EU) 2017/2394 and (EU) 2018/1724 as regards the discontinuation of the European online dispute resolution platform, provided for the discontinuation of the submission of new complaints from 20 March 2025 and the repeal of Regulation (EU) no. 524/2013 with effect from 20 July 2025. No reference to that platform is therefore any longer possible, and any reference to it that may appear in previous versions of the contractual documentation is to be regarded as of no effect.
The European framework on the matter is set to change. Directive (EU) 2025/2647 of the European Parliament and of the Council, amending Directive 2013/11/EU, was published in the Official Journal of the European Union of 30 December 2025 and entered into force on 19 January 2026; its scope expressly includes contracts in which the consumer provides personal data in place of the payment of a price, a category to which the relationship governed here belongs. Member States are required to adopt the transposition provisions by 20 March 2028 and to apply them from 20 September 2028. Before that deadline the Company will assess the need to adapt this clause to the national implementing rules.
The possible invalidity, nullity, or ineffectiveness of a single clause does not affect the remaining provisions, which retain full effect. The invalid clause is replaced as of right by the applicable legal provision or, failing that, is interpreted in the sense that best approximates the parties' original intention within the limits permitted by the legal system.
The Company's tolerance of conduct at variance with these Terms does not constitute a waiver of the right to enforce them subsequently, nor does it entail a tacit modification of the contractual arrangement.
The user may not assign their contractual position to third parties without the written consent of the Company. Hoomie may assign the contract in the context of transactions involving the transfer of the business or of a business unit, of merger, or of demerger, giving notice to users and without prejudice to the latter's right to delete their account.
Communications addressed to the user are deemed validly made to the email address associated with the account or by notice within the application. It is the user's responsibility to keep their contact details up to date.
These Terms are drafted in the Italian language, which constitutes the only authoritative version. Any translations into other languages are of mere courtesy and, in the event of discrepancy, the Italian text prevails.
